The third stage is the phallic stage where the child is three to five years of age. The key source of libido here is the child’s penis or vagina and pleasure is obtained from masturbation. At this stage the child will encounter Electra complex and associate with their mother if they are female, whereas if the child is a male they will encounter Oedipus complex where he will associate with his father. Through being affected by this information positively, the superego is developed and they include the morals of the self-same sex parent along with association of gender and sex duties. If they do not associate with the self-same sex parent then they will become fixated at this level and this could possibly lead to homosexuality. The fourth stage is the latency period. At this period the child is six years of age. The latent period is a time of investigation in which the sexual drive is still present, but it is directed into other areas like intellectual pursuits and social interactions. They have reached puberty and the key source of gratification is playing with peers of both sexes. During this stage the child is active with playing with their peers that not much befalls in terms of sexuality. If fixation befalls here the child will not feel content with members of the incompatible sex because they grow up and will find it to build heterosexual relationships. This stage is essential in the development of social and communication skills and self-confidence. The final stage is the genital stage which arises from puberty and the key source of libido/gratification here is having sexual intercourse with others. At this stage the persons interests and feelings towards others benefit will develop and they try to create a balance among their discrete lifestyles. If fixation has arose throughout any other stage, it will become  obvious at this psychosexual stage. Though, a different concept was suggested by Erik Erikson which approved with Freud’s theory to a degree. This was Erik Erikson’s psychosocial stages of development. He thought like Freud that everyone grows in stages, however these stages endure during our life and rather than having a greater focus on the lust for indulgence we must deem our need to be tolerated also. Erikson suggested eight psychosocial stages of development. Stage one is where the child is aged from zero to one years of age and the focal point is how the infant is raised. If they are raised in the right way, then they will form trust, but if the infant isn’t raised in the right way, then the infant will begin to not trust parents/guardians and their surroundings. Stage two is where the child is aged from one to three years of age and the focal point is being permitted to freedom. If this is done appropriately the child will develop some sort of autonomy. If they are continuously criticised the child will interrogate their own aptitude. Stage three is where the child is three to six years of age and begin to interact with the everyone. If the child is persuaded to endeavour different things and develop different skills and qualities, it will enable them to develop capabilities and self-assurance. However, if the child is continuously criticised and made culpable, then it will cause low confidence. Stage four is where the child is six to twelve years of age and focuses on the knowledge of how things operate. If the child begins to accomplish practical jobs they will form some kind of hard work however, if they are being pressured on specific tasks that they cannot accomplish will cause subservient and make them feel incapable. Stage five is where the person is twelve to eighteen years of age and the main focus at this stage is developing some sort of individuality by experimentation. Through being permitted to do the experiment, the child could then possibly develop a secure identity. However, not experimenting means they do not create a secure identity and causes misperception and negative identity. Stage six is where the person is aged eighteen to forty years of age and will focus on discovering new relationships to lead to long term commitments with each other. By creating these secure and committed relationships the sense of safety and be associated to devotion leads to a sense of love. Though,  through ignoring closeness and having phobia of commitment can cause the person to isolate them-selves and this little amount of love and could cause depression. Stage seven is where the person is aged forty to sixty five and the main focus is creating a career and having a family. Through having a career and giving back to society by parenting children and participating in community services, the person receives a sense of love and care. However, not getting participating with society could possibly cause a feeling of wasting life and being unfruitful. Stage eight is the final stage and here the person is over the age f sixty five. The person’s focal point at this stage is working less actively and intensely and think about their accomplishments during the course of their life. Through, performing this successfully, the person develops the merit of understanding that enables them to look back on their life with a feeling of accomplishment. This way the person is then able to can accept passing deprived of being afraid. Though, if the person has feelings of culpability about their life or has an insufficient achievement which will cause feelings of lead to feelings of desolation and frequently depression and as a result phobia of death. A benefit of the psychodynamic approach is that it is developed in stages. These stages make it easier to examine and give back up due to the fact that the stages are simple and easy to follow and acknowledge, therefore, making it easier to gather support for. On top of this, the stages developed by Erikson have more logic than Freud’s psychosexual stages because they make sense and are easy to acknowledge. This means that it can be easily implemented in health and social care practises. For instance in the counselling and treatment centre the health and social care workers are then able to use their insight of the eight stages of Erikson’s concept to detect why the person is feeling dejected has insufficient autonomy and tried to give most appropriate remedy. Though, some issues can be discovered with the psychodynamic approach. A problem is that the approach doesn’t use scientific methodology which means that it is based on opinions. This makes it hard to depend on the results because they are not a dependable source. This insufficient facts means the  approach is can be proven false. On top of this, a lot of the backing research originates from case studies. Though, these enable us to get in detailed information about one person. They might not be the most convenient when it comes to application to other people because the results can’t be generalised to the overall populace. A well-known case study that has been implement by Freud was the case of Little Hans, which was used as assistance for his psychodynamic approach. Little Hans had a fear of horses because he thought that they would hurt him or cause chaos. Little Han’s dad after being consulted by Freud, interpreted his fear through saying that the horses looked like his dad and that the phobia of being bitten signifies the fact that Little Hans was encountering the Oedipus complex and had a phobia of being castrated by his dad as of his feelings about his mum Little Han’s father and played a role his analyst and interpreted his sexual desires and associated these back to the Oedipus complex. Though, there are numerous factors to the Little Han’s case study that have been neglected. For instance, Little Han’s was more petrified of his mum because she threatened to cut off his penis because he was persistently fiddling with it. Also, after Freud spent some time with Little Han’s his parents split up. This means that Little Han’s phobia might be as of the reason that his parents ended their marriage and not be as of Oedipus complex. On top of this, his mum was also spiteful to her baby daughter, therefore it can possibly be that the ‘row’ he was scared of was the crying of his baby sister. Additionally, Freud analyse Little Han’s fear him-self. It was his dad who used Freud’s instructions in order to cure Little Han’s phobia. This means that, as his dad is not an expert analyst, he didn’t get the ideal remedy and the interpretations made might have possible been wrong, and so leading to inadequate remedies . This case study indicates that there are numerous different factors that Freud didn’t deem which could have been the motive of Little Han’s’ phobia. His phobia might have been better elucidated through operant conditioning. Little Han’s had witnessed a falling horse before, therefore, it might be that he related his fear at that instant with the falling horse and therefore develop the phobia.   However, Freud was capable to gather an adequate amount of data about Little Han’s which helped him in the explanation of his fear. However, his case studies are subject to partiality as most of his case studies focused on middle-class Victorian female, however some of his cases focused on males. This indicates that his results are sex bias and might not be relevant to the opposite sex. Also, his explanation are opinion based which means that they might vary to another psychoanalyst’s explanation. This could possible lead to issues to the welfare of the person who will not get remedies as of dissimilar information they are getting. Another problem with the psychodynamic approach is that the therapies people get entails time and dedication. This means that the client needs to be dedicated in the remedy in order for them to recover. Another therapy like medicine might possibly be quicker, however psychoanalysis has a more long term effect on the person. Where remedies can lead to deterioration, psychoanalysis will alter the client’s perception and lead to long term modifications. Role of the Jury in the English Legal System The jury trial is considered to be one of the most controversial elements of the justice system in the UK. The practice of trial by jury has shown over the years to have many disadvantages that which causes concern to society and must be reconsidered by Parliament. The key issues that have arisen of the years relating to the use of juries are a) the experience and intellect of the jurors making judgements in complex cases; b) the expensiveness and longevity of jury trials; and C) the fairness of jury selection. This essay shall try to critically analyse the role of the jury within the English legal system and explain why the jury trial should no longer play a part in the criminal and civil justice systems of the United Kingdom. Trial by jury was first introduced into the justice system in the twelfth century, however it was not a guarantee until many years later, when a clause within the Magna Carta stated that no free man shall be taken or imprisonedà ¢Ã¢â€š ¬Ã‚ ¦except by the lawful judgement of his peers or by the law of the land[1]. The role of the jury has since evolved from the medieval times and was completely formed in the 18th century into what it is today[2], with modern juries playing a vital role in assessing the facts of the case and, in the case of a criminal trial, determining whether the defendant is guilty beyond reasonable doubt, or in the case of a civil trial, deciding whether the claimant has the right to damages on the balance of probabilities. Towards the end of the 1900s, public attention started to be drawn towards problems arising with jury reliability, selection, experience, and bias. The Criminal Courts Review by Lord Justice Auld in 2001 was a crucial argument in the discussions concerning jury trials. Auld goes on to say that support for the jury system is not universal, especially among those who have been jurors.[3] This suggests that there is a considerable amount of negative opinion among former juror members about the jury system. The main drawbacks presented within this report were a) lack of experienced jurors who represent different social layers, b) poor ethnic minority representation, and c) the game character of the trial process, where the truth is not as important as victory.[4] The Criminal Justice Act 2003 did however alter the jury system and selection process by stating that a) if the judge ruling the case is satisfied, certain fraud cases and cases where a danger of jury tampering existed are not t o be tried by a jury; and b) the jury selection system had to be improved in order to provide more experienced and unbiased people representing different social groups and ethnic minorities.[5] Statistics have shown that jury trials are actually very rare. Only one in every hundred criminal trials are actually tried by jurors due to restrictions on the use of jury trials.[6] But it is not only the restrictions imposed that make access to jury trial very complicated. What also makes it complicated is the extortionate amount of money and long periods of time that must be put into each case, which puts jury trials at a disadvantage. These problems can make it extremely inconvenient and draining for both the defendant and, in particular, the members of the jury as they will have to spend a lot of their time getting through the necessary procedures and partaking in the actual trial. Jury trials can last from a couple days to many weeks, even months. During that period, members can be on a jury for more than one trial during their service.[7] In one instance, a juror failed to turn up for a trial as she found it really boring, resulting in the trial being suspended before continu ing with 11 jurors.[8] This suggests that sitting on a jury is not what is hyped up to be, and that the negatives vastly outweigh the positives of sitting on a jury. The qualification rules for jury selection has also been often criticised. According to the Juries Act 1974[9], the criteria to serving on a jury are: 1) the person should be registered as a parliamentary or local elector; 2) the person should not be less than 18 and no more than 65 years old; 3) the jury should have been ordinarily resident in the UK for a period of at least five years since his or her 13th birthday. The criterion set out in the Act is quite narrow and should be broadened in order to ensure better quality of juries. Ineligible persons include past and present members of the judiciary, other people who have been concerned with the administration of justice, the clergy and mentally ill people. The Criminal Justice Act 2003 also disqualifies individuals who have served a custodial sentence within the past ten years, received a lifetime custodial sentence, or are released on bail and awaiting trial at the time the jury is summoned.[10] However the issue is not in relati on to the qualification of jurors, but the mere fact that jurors are subject to human error. As the selection criteria is very narrow, there will be individuals who are well educated as well as not; some who are very responsible and some who are not; and individuals who are wanting get gain a better understanding of the case while others just wanting to get home as soon as possible. In the case of R v Litchfield,[11]it was up to the jury to decide whether or not negligence was gross negligence. As a result, the jurys verdict was confused and instructions from the judge had to be restated. It is clear to say that members of the jury in this case were either not educated well enough or had no experience at all in dealing a complex judgement, which is presumably the case with all jurors.[12] Many jurors do encounter problems that are far beyond their training and experience, as the lack of legal knowledge allows prosecutors to easily sway jurors to believe their assertions. But not only are jurors unskilled and inexperienced, they often disregard logic presented by the lawyers because of their prejudices, past experience, or moral sentiment. Some jurors may even follow the majority and make the same verdict as the stronger personalities. But the main problem is that, as jurors do not usually know the law and legal procedures, they are often unable to understand complex evidence or to assess the reliability of a witness or evidence. A research study by Matthews, Hancock and Briggs[13] shows that jurors fees very enthusiastic about their role in the trial process, however one third of jurors feel that it is inconvenient. The report also shows that well-educated skilled people and professionals are under-represented as only skilled manual workers and unskilled workers have enough time to be part of longer trials. From this, it is clearly obvious that the education level of many jurors is comparatively low. Approximately 60% of the respondents were confused and had difficulties while listening to evidence and following instructions. Furthermore, about 30% of jurors face a language barrier and would need a translator. Having a translator would make the evidence unclear as translations are not always presented in the right way. The study also shows that a third of jurors are uncomfortable being in a courtroom, but also 90% of jurors are satisfied with being a member of the jury and realise he meaning and importance of the role. Additionally, 30% of jurors are not well educated (do not have a degree) and 40% of people have no knowledge of the court process. These statistics are an indication that jury selection must vastly improve. All these issues can be ratified by giving jurors more detailed instructions before trial starts and balancing the number of people with different education levels. Cheryl Thomas states in her research that there are serious race disproportions in the jury structure and ethnic minorities are truly under-represented.[14] Thomas also agrees that instruction need to be more clear, simpler and broad as many jurors claim they have faced difficulties when studying such instructions. However, she also goes on to report that some of the problems concerning race stereotypes within the jury system are highly exaggerated, and have found no proof that white jurors are likely to be biased and make unfair verdicts. With that in mind, remedies must be made to ensure that it is a fair selection and that individuals from all backgrounds are represented in a jury trials. In 2007, the Ministry of Justice published the findings of the Jury Diversity Project[15] which revealed that most defendants in Crown Courts outside of London will be tried by an all-white jury. The role of the jury in the English legal system remains a controversial part of the judicial system. Complications have arisen by issues of jury selection; costs and longevity of each trials; and the experience and intellect of jury members summoned to partake as a jury member. With many sources proving that a) jurors lack the required intellect and experience to handle complex trials and make fair judgements; b) individuals from all backgrounds, especially ethnic minorities, are under-represented; and c) the length of time for jury selection and trial being too long for an individual to handle suggests that the whole process of jury trials need to be reconsidered. A number of former jurors tend to have more of a negative opinion on the use of juries due to the fact that they did not know much about the law, instructions were not given clearly, they could not tell whether to disregard a piece of evidence or not, along with many other issues. However while juries have been an integra l part of the judicial system and being assessed by ones peers and not by the judiciary seems fair, non-jury trials have had the least amount of criticism. It is clear to see that jury trials should no longer be a part of the legal system of England and Wales and that all aspects of a trial including analysing the facts of the case as well as the application of the law should only be the responsibility of the judiciary. The Travellers: Ireland’s Ethnic Minority Who are the Travellers? The Travellers, a minority community indigenous to Ireland, have existed on the margins of Irish society for centuries. They share common descent, and have distinct cultural practices - early marriage, desire to be mobile, a tradition of self-employment, and so on. They have distinct rituals of death and cleansing, and a language they only speak among their own. Travellers are not overtly conscious of a sense of group history. Concern with ancestry is an obsession of those who value permanence of place. Rather, the individual is defined by his/her place within the relationship network. They live in extended patriarchal families, prefer trailers, tend to nomadism interspersed with occasional house dwelling, and maintain a nomadic mindset even when settled; a house is considered only a stopping place between journeys, whether the stop lasts 20 days or 20 years! There are an estimated 21,000 Travellers currently living in the Republic of Ireland, over half of whom have no access to toil et facilities, electricity, refuse collection or piped water. In the past they invariably travelled, but misguided government policy from the 1960s onward ensured that many were persuaded to settle in houses – a policy that, in undermining traditional values and lifestyle, is increasingly questioned, if not actively altered. Traditionally, they were metal workers, hawkers, traders in horses and used goods of all description, and provided services where and when there were gaps in the market. This resistance to wage labour and alternative cultural definition of work led to charges of idleness by the uncomprehending. The necessity of living on their wits led to a stereotype of Travellers as shrewd, even cunning, dealers. Having been persuaded to settle in houses, and consequently, having lost the mobility necessary to their traditional trades, many Travellers today rely on state welfare assistance. This could be construed as a sinister government plot, but for the fact that government policy on Travellers has never been well planned enough to effect any successful strategy! Ironically, Traveller representative Michael McDonagh believes that â€Å"Travellers that are the most nomadic are also the most economically successful, and also have far less difficulty with their identity than people forced into settlement† (quoted in â€Å"Nomadism in Irish Travellers’ Identity†. Assimilation of Blacks in Song of Solomon, Push and The Interesting Narrative of the Life of Olaudah Equiano      Ã‚   Our African American texts call for close examination of the status of slaves and subsequent generations of free Blacks, how they fit into American society, and their quest for and denial of the benefits of Americanism. So does one assimilate or resist? But The Melting Pot Theory is not inclusive of Blacks since the process of assimilation could not work its magic on black skin.    In the slave narrative, The Interesting Narrative of the Life of Olaudah Equiano, or Gustavus Vassa, The African, the capture of Africans, their ultimate enslavement in the Americas, the West Indies, and Europe exemplify the assigned inferior status to Blacks in societies of the alien worlds. Blacks have less than their proportionate share of wealth, power, and social status, and are discriminated against by those in the majority. The yoke of slavery did not sanction inclusion, instead it convoluted their status as immigrants or a colonized minority and that sentiment remained a constant. Equiano's race and his life as a seafaring slave narrowed his opportunity of citizenship in a landed community; consequently, he was neither immigrant or colonized. In fact, he was more displaced that ever, sailing under whatever flag happened to be that of his owner/captain. In Song of Solomon and Push the characters are several generations removed from slavery so the question is not whether the po sition of Blacks is that of immigrant or colonized minority, even though it could appear to be either. More importantly, theirs is the problem of dealing with the ambiguities of being "up from slavery," as the characters come into their own. The su... ...rally fixed neighborhoods, or "sell out" by embracing the dominant culture and sometimes attempting full assimilation (although it is realized impossible) in order to advance one's career, and acquire better housing and/or education for one's children is ubiquitous. Justice in Aeschylus' The Oresteia How can an endless and violently destructive cycle be just? The concept appears in places along the human timeline as diverse as the Bible and West Side Story. Why do people have a tendency to amplify and repeat violence through a cycle of murder and revenge, and how can this destructive process be called justice? In The Oresteia, the cycle is a familiar one, but is also interweaved with gender issues and a sense of justice that changes within the cycle itself. Instead of focusing on one book of the trilogy, I think it will be more worthwhile to see how these patterns flow through all three books.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   The first chapter of the trilogy is the story of Agamemnon, the war hero of Troy who returns home after 10 years. The King had left on a rather sour note, having murdered his daughter Iphigenia to appease the Gods in order for the fleet to sail for Troy. Clytomnestra, the Queen, cannot understand the sacrifice. This is the first occurrence of the so-called gender battle in the trilogy. Agamemnon’s actions are typical of the classic Greek ‘male’ point of view. He is mostly concerned with issues of war, honor and the welfare of the city. Clytomnestra, in contrast, is more concerned with ‘female’ issues, such as the welfare of the family. The Queen, during the King’s absence, becomes obsessed with her daughter’s death, and takes a new lover to the exclusion of her remaining children in an attempt to steal control over the city. When Agamemnon returns, instead of a faithful wife he finds a quick death at the hands of Aegithus. It is interesting to note that another person is also killed, an innocent. Clytomnestra kills Cassandra, a prophetic girl brought home from Troy, on a whim... ...ause it would only allow him to act out more injustice. Still, the idea of making him a better person relative to the values of society is somewhat anti-Socratic. Socrates would rather there be an absolute ideal, without room for human opinion or emotion. Unfortunately, practical situation often preclude the actualization of his ideal. His logic still entails to the idea of relative justice. In modern terms, this would be akin to sentencing criminals to time in therapy or mental health institutes rather than incarceration. This is not so radical a departure from what proponents of capital punishment suggest. But is society ready for a justice system where the guilty are not punished? I don’t think so.
